Drug-Free Workplace Policy

Policy:

  1. Covered Workers: Any individual who conducts business for the organization, including employees and contractors, conducting business on the organization's property, is covered by our drug-free workplace policy. This policy applies to the CEO, managers, supervisors, full-time employees, part-time employees, and contractors, among others.
  2. Applicability: Our drug-free workplace policy applies whenever anyone is representing or conducting business for the organization. It includes working hours, conducting business, representing the organization, and while on call or paid standby. The policy also extends outside of work hours for the use of any illegal drug.
  3. Prohibited Behavior: It is a violation of our drug-free workplace policy to use, possess, sell, trade, and/or offer for sale alcohol, illegal drugs, or intoxicants while on or using company property, conducting company business, or otherwise representing the company. Using prescription drugs illegally is also prohibited, but legally prescribed medications are allowed. Employees must notify their supervisor if prescribed medication may affect their job performance.
  4. Medical Certification: Due to the nature of therapeutic work, any employee with substance abuse-related issues is prohibited from providing services to the organization until a medical professional certifies full remission of any possible diagnosis and/or condition related to alcohol and substance abuse. Such certification is required to ensure the safety and well-being of both employees and clients.
  5. Notification of Convictions: Any employee convicted of a criminal drug violation in the workplace must notify the organization in writing within five calendar days of the conviction. The organization will take appropriate action within 30 days of notification. Federal contracting agencies and company clients will be notified when appropriate.
  6. Consequences: Violations of the policy will result in disciplinary action, including a letter of reprimand, suspension without pay (which may require rehabilitation), and potential dismissal. The disciplinary action will be approved by the highest authority in the company after considering all pertinent evidence.
  7. Assistance: The Company recognizes that alcohol and drug abuse are treatable illnesses. Employees are encouraged to seek help if they have concerns about drug or alcohol problems. The company provides information on qualified community professionals and allows the use of accrued paid leave for seeking treatment. The financial responsibility for treatment belongs to the employee.
  8. Drug Testing: The Company is committed to providing a safe working environment and may conduct drug and alcohol testing to ensure the safety and health of patients and staff. Employees are subject to random testing, testing based on reasonable suspicion, after accidents or unsafe practices, and as part of follow-up to counseling or rehabilitation. Certain sensitive positions may require more frequent drug testing.
  9. Confidentiality: All information related to the drug-free workplace program is confidential and limited to those with a legitimate need to know, as required by relevant laws and management policies.
  10. Shared Responsibility: Both employees and management share the responsibility for maintaining a safe and drug-free workplace. Employees are required to not report to work or be subject to duty while impaired by alcohol or drugs and encouraged to support fellow workers seeking help. Supervisors must inform employees about the policy, investigate dangerous practices, and refer employees to the drug-free workplace assistance program.
  11. Communication: To ensure that all employees are aware of their role in supporting the drug-free workplace program, they will receive drug and alcohol awareness information, including a written copy of the company policy, information on the dangers of drug and alcohol abuse, and the availability of local community resources.
  12. Goal: The goal of this policy is to balance respect for individuals with the need to maintain a safe, productive, and drug-free work environment.
