Employee–Patient Relationships
The Company provides professional services in the field of Applied Behavior Analysis (ABA). These services apply accepted scientific principles and methodologies to support behavior change in individuals. To deliver these services properly, the Company employs Board Certified Behavior Analysts (BCBA), Board Certified Assistant Behavior Analysts (BCaBA), Registered Behavior Technicians (RBT), and other clinical and support staff.
Consistent with the policies of the Behavior Analyst Certification Board (BACB), every BCaBA and RBT who delivers services in the ABA field must be supervised by a BCBA. Each BCBA is bound by the BACB's ethical requirements, which govern the BCBA's own conduct as well as the conduct of those working under the BCBA's supervision. As a result, every employee of the Company who provides services to patients must be familiar with, and conform to, the ethical requirements imposed on the supervising BCBA. The applicable BACB Ethics Code for Behavior Analysts, including the provisions that apply to RBTs, sets the standards governing the relationship between Company employees and patients. Each field employee must become familiar with the current Ethics Code.
The Company also adheres to the federal HIPAA Privacy Rule and Security Rule (45 CFR Part 164), which govern responsibility for patient care, patient privacy, and the storage of patient files. Patient confidentiality in Florida is further reinforced by Florida Statutes Sections 456.057 and 395.3025, which protect medical records. A summary of the HIPAA Privacy and Security Rules is provided in this Handbook; full text of the rules is included in the appendices.
